
In the vibrant city of Chicago, the word “dope” has taken on a new cultural significance thanks to historian Shermann “Dilla” Thomas. Known for his engaging storytelling about Chicago’s rich history, Thomas popularized the phrase “Everything Dope About America Comes From Chicago.” This catchy slogan became his trademark, but now it’s at the center of a legal battle.
The Swedish ski apparel company, Dope Snow, is challenging Thomas’s trademark, arguing that his use of the word “dope” infringes on their brand, which they registered in 2020. The historian, however, faces an estimated $20,000 in legal fees to defend his trademark, highlighting the challenges individuals face against larger corporations.
A detailed report by Block Club Chicago explains how Thomas and his attorney India Rios filed for the trademark in May 2025. Thomas’s slogan gained traction on social media during the pandemic, even catching the attention of BBC in a feature. However, Dope Snow claims his trademark dilutes their brand, despite having 70 pending oppositions against other uses of “dope” in trademarks, including “DopeSoul” and “Dope-Tastic.”
Rios argues that Dope Snow’s claim lacks merit because “in order to have a successful dilution claim, you have to have a world famous mark,” such as Coca-Cola or Nike. Rios noted, “Most people have never heard of Dope Snow.” Furthermore, she stated that attempting to enforce their claim against Thomas seems unwarranted as “the two marks as a whole…are not the same.”
Thomas expressed concern about the financial implications of the dispute, noting that Dope Snow proposed a coexistence agreement. This would require Thomas to drop Trademark Class 25, which could allow others to use his slogan for merchandise, undermining his brand.
Rios plans to demonstrate the generic nature of “dope” using the Polaroid Factors, a legal test for assessing potential trademark confusion. She predicts the legal proceedings could extend over two years, leaving Thomas in a prolonged battle to protect his slogan.
