Legal Battle Intensifies Between Tech Titans Musk and Altman
Elon Musk and Sam Altman are gearing up for a significant legal face-off, as a court battle looms on the horizon.
In a critical hearing on Wednesday, a judge in California indicated her intention to dismiss the attempts by Altman’s legal team to halt Musk’s lawsuit against OpenAI and its chief executive officer. “This case is going to trial,” announced US District Judge Yvonne Gonzalez Rogers.
Judge Rogers highlighted the presence of substantial evidence supporting Musk’s claims, stating, “It’s circumstantial, but that’s how these things work.”
Musk’s lawsuit, filed in 2024, accuses OpenAI of straying from its original nonprofit mission, opting instead for a profit-driven approach, a move he claims was not disclosed to him, especially concerning its collaboration with Microsoft. More details on the lawsuit can be found here.
According to Musk, he contributed $38 million to OpenAI, the creator of ChatGPT, to aid its mission of developing AI for humanity’s benefit. The judge remarked on the assurances and promises that were supposedly made to maintain OpenAI’s structure, noting, “There was lots of information that was not shared.” Despite this, she acknowledged the robustness of the defense’s arguments, concluding, “I think the jury is going to get to decide.”
OpenAI’s attorneys have countered Musk’s accusations, asserting that Musk was aware of the company’s for-profit plans as early as 2018. They also emphasized that OpenAI remains under the control of its nonprofit division. More about OpenAI’s structure is available here.
In addition to the current lawsuit, Musk’s AI company, xAI, lodged another lawsuit against OpenAI in September, accusing it of stealing trade secrets and attempting to poach its employees. An OpenAI spokesperson labeled the lawsuit as “the latest chapter in Mr. Musk’s ongoing harassment.”
Musk co-founded OpenAI in 2015 but departed in 2018, citing potential conflicts with Tesla’s AI goals. Since then, he has been vocally critical of Altman and OpenAI’s organizational choices, eventually establishing his own AI company, xAI, in 2023.
