State Ballot Initiatives in 2024: A Mixed Bag of Results
The 2024 election cycle saw a variety of state ballot initiatives tackling contentious issues, each with its own unique journey and outcome. Notably, several states had initiatives concerning abortion rights, which resulted in a spectrum of results across the nation. While conservative states such as Missouri and Montana successfully passed abortion rights initiatives, similar efforts were unsuccessful in states like Florida, South Dakota, and Nebraska.
Another significant ballot initiative in Ohio aimed to eliminate partisan gerrymandering, yet it did not pass. This stands in contrast to prior successes in states like Arizona, Michigan, and California, where similar measures have been approved in past elections. The differing outcomes across states can be attributed to various factors, including constitutional requirements and the role of state courts.
For instance, Florida’s constitution necessitates a supermajority of 60 percent to approve any constitutional amendment, a hurdle that affected the success of initiatives. Additionally, the role of state courts was instrumental, as those in Missouri and Montana took active measures to shield voters from potential state-sponsored misinformation, aiding the passage of initiatives. Conversely, courts in Florida and Ohio did not offer the same level of intervention.
In Missouri, the process for a citizen initiative involves a description being drafted by the Secretary of State once the initiative is approved for the ballot. Missouri’s Secretary of State, Jay Ashcroft, an opponent of abortion, crafted a contentious description for the state’s abortion rights initiative. This description misleadingly suggested that the initiative would permit “dangerous, unregulated, and unrestricted abortions,” sparking a lawsuit from supporters of the initiative.
