The brothers, who face allegations of rape and sex trafficking in the UK, argue that their prominent public personas should be considered a special circumstance for their release.

Andrew and Tristan Tate’s attorneys have filed a motion for their release, which will be reviewed by a Miami federal court judge next week. The decision will determine if the brothers remain in custody during the extradition proceedings, which could extend for several months. The Tates, known for their controversial social media presence promoting wealth and male dominance, have consistently denied any wrongdoing related to the accusations.
Arguments for Release
The defense acknowledges the general presumption against bail in extradition cases but argues that the Tates’ case is exceptional. The motion claims their global notoriety makes them unlikely to flee, emphasizing their consistent social media updates that disclose their whereabouts. “Every prediction the government now asks this Court to make about the brothers’ future conduct — that they will flee if released — has already been made and answered by three years of data showing that they do not flee,” the motion states.
