Brazil Supreme Court Faces Crisis as Justices Seek Sanctions Against Each Other

Brazil’s Supreme Court Faces Internal Turmoil Amid Justice Disputes

The highest judicial body in Brazil, the Supreme Court, finds itself at the center of an escalating conflict involving two of its prominent justices. This turmoil reflects deeper institutional challenges as accusations and demands for sanctions fly between the judges.

Justice Alexandre de Moraes, who gained national attention for his role in the case against former President Jair Bolsonaro, and Justice Andre Mendonca, the court’s first evangelical member appointed by Bolsonaro, are now at odds. The dispute is rooted in a federal investigation into financial misconduct linked to the now-defunct Banco Master and its former owner, Daniel Vorcaro.

Mendonca has called for de Moraes’ suspension while the court deliberates on a possible corruption case involving him. Conversely, de Moraes has requested an investigation into Mendonca’s actions, accusing him of unauthorized proceedings, with the potential for impeachment by the Senate.

The justices’ seats on the bench are determined by their appointment order, placing them side by side. Recently, Mendonca disclosed intercepted communications from Vorcaro, which highlighted frequent consultations with de Moraes. This revelation has intensified scrutiny after it was discovered that de Moraes’ wife provided legal services to Banco Master under a substantial contract worth 130 million reais ($25 million).

Messages from Vorcaro to de Moraes, such as “I am grateful to you for my life” and requests to block actions against Banco Master, have added to the controversy. The situation has drawn attention from political figures, including presidential candidate Flávio Bolsonaro, who urged de Moraes to step down amid the scandal.

Complicating matters, Mendonca admitted to meetings with Vorcaro, including an unauthorized interrogation without the presence of federal police or prosecutors. This has further fueled the crisis within the court.

On Thursday, de Moraes took decisive action, requesting Chief Justice Luiz Edson Fachin to investigate Mendonca for what he described as politically motivated actions. Meanwhile, the Senate holds numerous impeachment requests against de Moraes and fewer against Mendonca.

Reports indicate that Mendonca has also petitioned Fachin to suspend de Moraes, citing recent disclosures. In response, the Chief Justice has called for explanations from both justices, the Attorney General, and federal police officials involved.

During a ceremony with President Luiz Inácio Lula da Silva, Chief Justice Fachin emphasized the importance of preserving the Republic’s institutions amid heightened tensions. He assured that the situation would be addressed following legal procedures, though refrained from directly naming the involved parties.

The strained relationship between de Moraes and Mendonca was evident as they refrained from communicating during recent court sessions. Their next encounter is scheduled for the upcoming week.
