Judge’s Ruling Allows Arizona Immigration Measure to Stand Temporarily
An Arizona measure aimed at addressing illegal immigration remains in effect, following a federal judge’s recent decision. The measure, known as Proposition 314, was approved by voters and has become a contentious issue in the state.
Judge Michael Liburdi, after conducting a 90-minute session of arguments, determined that the claims of a migrant aid organization were based on speculation. The group had contended that it would suffer irreparable harm if the measure were enforced.
The new law, effective beginning in 2024, categorizes unlawful entry into Arizona from another nation as a misdemeanor and grants state judges the authority to order deportations.
Critics, including the migrant aid organization, argue the measure conflicts with the supremacy clause of the U.S. Constitution, which grants the federal government predominant control over immigration policies.
The judicial proceedings addressing these constitutional concerns are ongoing.
