Mesa’s decision to impose landing fees at Falcon Field Airport has sparked a legal challenge from local flight schools, raising questions about the legality and implications of such fees. A lawsuit has been initiated against the city by two flight schools operating at Falcon Field, CAE Aviation Academy and Thrust Flight Properties. These schools contend that the fees contravene both city ordinances and the Commerce Clause of the Constitution. According to the legal documents, the schools are seeking a court injunction to halt the fee enforcement.

The Mesa City Council sanctioned the landing fees on March 23, with plans for them to be implemented starting July 30. As outlined by the city, the primary aim of these fees is to provide financial support for the airport’s operations. However, the flight schools argue that the charges are disproportionately aimed at them, ostensibly to mitigate the airport’s noise and traffic issues.

In response to the lawsuit, Mesa officials have stated that the legal challenge is without substantial legal grounds and should not impede the fee program’s implementation.
