Preparing Michigan for a Federal Constitutional Convention
In a recent development, a Michigan House Committee convened to discuss a policy aimed at preparing the state for a potential federal constitutional convention. The proposal entails a concurrent resolution outlining how Michigan’s convention delegates would be appointed and a bill detailing their roles and limitations.
Delegate Selection Process
According to the plan, the majority and minority leaders in the House of Representatives and Senate would each nominate a delegate. Subsequently, these four delegates would collectively choose a fifth member to join their ranks.
Guidelines and Consequences
The delegates would be subject to strict rules, with potential felony charges and up to five years in prison for overstepping their designated duties. Any form of bribery or coercion to influence others’ actions during the convention would be met with severe consequences.
Constitutional Convention Process
Convening a constitutional convention through state legislatures, as outlined in Article 5 of the U.S. Constitution, necessitates the participation of 34 states, constituting two-thirds of the total 50 states.
Ensuring Michigan’s Representation
Sarah Santana, Michigan state director for the Convention of States group, emphasized the importance of Michigan being adequately prepared for a potential convention to avoid being unrepresented. Currently, 20 states, including Florida, Indiana, and Wisconsin, have already called for a convention to propose changes to the U.S. Constitution.
Future Preparedness
State Representative John Fitzgerald expressed skepticism regarding the urgency of the proposed policy, questioning its relevance beyond the current legislative session. However, sponsor Luke Meerman believes that preparing for a constitutional convention is inevitable, and having the bill and resolution in place serves as a proactive measure for the future.
