Federal Court Rules Against Trump’s Tariff Powers
In a significant legal decision, the U.S. Court of Appeals for the Federal Circuit has determined that former President Donald Trump did not have the legal authority to declare national emergencies for the purpose of imposing widespread import taxes. This ruling largely supports a previous judgment made in May by a specialized federal trade court based in New York.
Despite this ruling, the existing tariffs will remain in effect temporarily. The court’s decision allows Trump the opportunity to appeal to the Supreme Court, with a deadline for appeal set before mid-October.
