Legal Battle Unfolds as Phoenix Police Sergeant Challenges Department Over Protest Actions
A Phoenix police sergeant, currently on paid administrative leave, is embroiled in a legal dispute with his department following his conduct at a student protest in Chandler earlier this year. The sergeant, Dusten Mullen, is taking legal action against the police chief to avoid termination, alleging procedural missteps and rights violations by the department.
The core of the controversy lies in claims that the Phoenix Police Department circumvented its established investigative protocols. In legal filings, Sgt. Mullen contends that his rights to free speech and due process have been infringed upon by the very organization he serves.
Mullen is petitioning a federal court to mandate a comprehensive review of his interactions during the protest, which he attended while off-duty, before any disciplinary measures are finalized. He argues that a full investigation is necessary to ensure fairness and transparency.
The situation has escalated to involve Phoenix Police Chief Matt Giordano, who placed Mullen on paid leave. Chief Giordano, along with Councilwoman Anna Hernandez, is named in the lawsuit. Hernandez faces accusations of breaching city code and the city charter.
This legal confrontation is set to proceed with both parties scheduled to appear in court on Monday morning.
