Mistrial Declared in Harvey Weinstein’s Third Rape Trial in New York

A mistrial was declared in Harvey Weinstein’s latest rape case in New York on Friday, as the jury failed to reach a unanimous verdict. This marks the third trial for the case, which has become a significant part of the #MeToo movement discourse.

The proceedings focused on allegations by Jessica Mann, a hairstylist and actor, who claims that Weinstein raped her in a hotel room in 2013. Mann testified that the encounter was non-consensual, while Weinstein’s defense maintained it was consensual. Weinstein chose not to testify during this trial.

Reasons Behind Multiple Trials

This case has been through the courts multiple times. Weinstein was initially convicted in 2020, but the verdict was overturned on appeal. The appeals court found that the trial judge allowed testimony that was not directly related to the allegations being tried. The retrial concluded with Weinstein being convicted on one count of criminal sex act but left Mann’s rape charge unresolved because the jury ceased deliberations after the foreperson opted out, leading to yet another trial.

Mistrial Outcome

Deliberations ended in a mistrial after the jury announced they were deadlocked, with no prospect of reaching a consensus. The judge declared the mistrial following a note from the jury stating, “We feel that no one is going to change where they stand.”

The jury, predominantly male, expressed doubts about Mann’s testimony, with some stating that nine out of twelve jurors leaned towards acquitting Weinstein. Juror Josh Hadar commented on Mann’s inconsistent memory during testimony, which affected their deliberations.

Future Legal Proceedings

District Attorney Alvin Bragg’s office will consult with Mann about pursuing another trial, considering Weinstein’s sentencing for his previous conviction. A decision regarding a potential fourth trial is anticipated at a hearing set for June 24.

Weinstein’s Current Incarceration Status

Weinstein remains incarcerated, despite the overturned 2020 conviction, due to a separate conviction in Los Angeles. He was sentenced to 16 years for rape and sexual assault in 2022 and is currently held at Rikers Island while awaiting further legal proceedings.

Previous Convictions

During a previous retrial, Weinstein was convicted of committing a criminal sex act against Miriam Haley, a TV and movie producer and production assistant, in 2006. In Los Angeles, he was found guilty of one count of rape and two counts of sexual assault against an Italian actor and model in a 2013 incident. Both accusers have chosen to publicly identify themselves.
