Trump’s Crypto Ventures Thwart Industry’s Legislative Efforts

The recent developments in the crypto industry highlight a paradox where its strongest supporter, President Donald Trump, inadvertently became a roadblock to a significant legislative achievement. This outcome was influenced by the revelation of the substantial profits Trump and his family garnered from their crypto dealings, as reported by the Wall Street Journal.

As the industry pivots towards regulation through crypto-friendly policies, the potential for Democrats to control Congress post-2026 midterms poses a threat to these regulatory wins. The possibility of Democrats gaining the White House in 2028 further complicates the industry’s future.

The proposed legislation, known as the Clarity Act, aimed at light regulation of crypto assets, had bipartisan backing and significant lobbying efforts behind it. However, the steady stream of reports on the Trump family’s lucrative crypto ventures weakened this support, particularly among Senate Democrats.

The legislation ultimately failed to pass a procedural vote in the Senate on September 15, 2026, as reported by Coindesk. This failure leaves the industry uncertain about its future political strategies, especially regarding campaign spending ahead of the midterms.

Crypto Industry’s Political Maneuvering

The Clarity Act intended to resolve whether crypto assets should be regulated as securities or commodities. Under President Biden, the SEC, led by Gary Gensler, treated most crypto tokens as securities, increasing scrutiny and enforcement actions. The industry argued that many tokens were decentralized and should not be subject to these regulations.

Following the 2024 election, there was optimism for a more favorable regulatory environment. The industry invested heavily, over $119 million, to support pro-crypto candidates. Trump’s administration brought some wins, like the signing of the GENIUS Act, regulating stablecoins.

Unveiling of Financial Gains

The Clarity Act held the promise of permanently easing crypto regulation. However, the bill’s progress was derailed by financial disclosures revealing Trump’s crypto-related income, exceeding $1.4 billion in 2025, as noted by CBS News. This, along with a Reuters investigation estimating the Trump family’s crypto earnings at $2.3 billion, fueled political backlash.

Challenges from Banking Sector

The push for the Clarity Act also faced resistance from banks, concerned about a loophole allowing crypto exchanges to offer interest on stablecoin balances. Although a compromise was proposed, it didn’t satisfy banks, resulting in their opposition.

The combined resistance from Senate Democrats, banks, and the crypto lobby’s complications led to the Clarity Act’s failure in the Senate, as reported by American Banker, leaving the industry’s future regulatory landscape uncertain.
