Analyzing Justice Alito’s Decision on Abortion Pill Prescription Changes

Supreme Court Justice Samuel Alito recently issued a one-week pause on significant alterations to the prescription guidelines for the abortion pill mifepristone. This decision comes after an appeals court ruled last Friday that the Food and Drug Administration (FDA) must return to the previous rule requiring in-person prescription of the medication nationwide.

Originally, the appeals court’s ruling meant that mifepristone could not be prescribed through telehealth services or mailed to patients. However, Justice Alito’s order temporarily reverses this decision, allowing the prescription changes to remain on hold until May 11 at 5 p.m.

Justice Alito’s intervention was in response to a plea for urgent relief submitted by the manufacturers of mifepristone. In addition to the temporary hold, he has requested all involved parties in the ongoing lawsuit led by the state of Louisiana to submit briefs by May 7 at 5 p.m.
