Teen Charged in Cruise Ship Tragedy Remains Free Amidst Legal Deliberations
A legal decision is pending in Miami that could determine whether a teenager accused of grave offenses on a Carnival Cruise ship is detained or remains free. U.S. Magistrate Judge Edwin Torres is considering arguments related to the case of Timothy Hudson, who faces serious charges following the death of his stepsister, Anna Kepner.
Initially arrested as a juvenile, Hudson was allowed to stay with an uncle under electronic monitoring. This changed when the case moved to adult court, prompting prosecutors to seek his detention. The rare federal prosecution of a minor is due to the incident occurring in international waters, beyond state jurisdiction.
Judge Torres concluded a hearing without a decision, expressing the need to consult the U.S. Marshals Service about potential detention logistics in central Florida, closer to Hudson’s family. Until a decision is reached, Hudson remains free.
Hudson, who has pleaded not guilty to first-degree murder and aggravated sexual abuse, was present on the Carnival Horizon in November, where Kepner’s body was discovered under a bed in the shared cabin. Autopsy results attributed her death to mechanical asphyxia.
Prosecutors, led by Assistant U.S. Attorney Alejandra Lopez, emphasized the severity of the accusations, citing evidence of forced rape and arguing against Hudson’s release due to the potential risk of harm. “I believe there is clear and convincing evidence that this defendant is a danger to the community,” Lopez declared.
Concerns about Hudson’s flight risk were highlighted, given the possible life sentence he now faces if convicted as an adult. Defense attorney Evan Kuhl noted Hudson’s compliance with release conditions, suggesting he poses minimal risk of fleeing.
Judge Torres recognized that adults facing similar charges would likely be detained but pointed to Hudson’s youth as a factor requiring careful consideration. While acknowledging Hudson’s low flight risk, the judge is yet to decide on the potential threat he poses.
In a prior statement, Christopher Kepner, Anna’s father, expressed faith in the justice system’s ability to handle the case with integrity. The family’s deep sorrow was evident at Anna’s memorial, where attendees honored her vibrant spirit by wearing bright colors.
