Cato Institute Report: 73% in ICE Custody Have No Criminal Record

ICE Detention and Criminal Records: An In-depth Look

Recent findings from the Cato Institute, a libertarian think tank, reveal surprising statistics about the individuals held in ICE custody. Despite the Trump administration’s stance on deporting criminals, the reality appears different.

According to Cato’s report, a striking 73% of those detained by ICE lack any criminal convictions. This includes those booked for minor offenses like traffic violations or immigration issues, while only a small fraction, 5%, have violent crime records.

The report draws from a combination of ICE booking records, publicly available detention data, and information accessed via the Freedom of Information Act. The data reflects a notable decrease in the number of immigrants with criminal convictions in ICE custody, dropping from 62% in January to just 31% by November.

Conversely, detainees without any criminal charges have surged, accounting for 40% of those held, up from a mere 6%. This data highlights a significant change from previous policies, marking a shift in the types of individuals detained by ICE.

As of mid-November, the Transactional Records Access Clearinghouse (TRAC) reports over 65,000 individuals in ICE detention facilities, underscoring the ongoing debates surrounding immigration enforcement and policy changes.
