Justice Alito treated for dehydration, back on bench shortly after

Supreme Court Justice Samuel Alito experienced a health scare recently while attending an event in Philadelphia. The incident, which raised concerns about the justices’ health disclosures, was resolved with prompt medical care for dehydration, allowing Alito to return to his duties shortly after.

Justice Alito, aged 76, faced a brief illness during an event in Philadelphia last month. According to court spokeswoman Patricia McCabe, he received treatment for dehydration but didn’t require an overnight stay at the hospital. By the following Monday, Alito was back on the bench, actively participating in important hearings, including a significant case concerning mailed ballots.

Alito’s health episode, initially reported by CNN, highlights the general reluctance among Supreme Court justices to publicly discuss their health conditions. CNN noted that Alito was treated at a Philadelphia hospital, but the court did not specify the exact location. This incident echoes a similar situation from 2020 when Chief Justice John Roberts’ hospitalization after a fall was only confirmed following media reports.

Alito, who celebrated his 76th birthday on Wednesday, is the court’s second-oldest member, following Justice Clarence Thomas, who is 77. Despite speculation about potential retirement, Alito has not announced any plans to step down. However, if he were to retire, it could provide former President Donald Trump an opportunity to nominate a fourth justice, should he return to office.

Alito’s appearance at a Federalist Society panel, marking his two decades on the court, was followed by a dinner where he began feeling unwell. Following the advice of his security team, Alito consulted a physician before embarking on the three-hour journey back to northern Virginia. McCabe confirmed that he was administered fluids to address the dehydration.

The possibility of Alito’s retirement has fueled discussions, particularly regarding the potential political implications. By stepping down, Alito could enable the appointment of a younger conservative successor, ensuring a lasting conservative influence on the Supreme Court.
