Michigan Supreme Court Justice Candidate Michael Warren Shares Legal Philosophy
In November, Michigan voters will have the opportunity to select two justices to serve on the state Supreme Court, a crucial decision that will impact the state’s legal landscape. As part of the election coverage, Michigan Public’s Morning Edition has been conducting interviews with the six candidates vying for these positions. One of the candidates, Judge Michael Warren, brings a wealth of experience to the table.
Experience and Legal Philosophy
Michael Warren has been a judge on Michigan’s Sixth Judicial Circuit Court in Oakland County for nearly 24 years, and his expertise extends to teaching constitutional law at Cooley Law School. When asked about his legal philosophy and approach to cases, Warren emphasized his commitment to applying the law fairly and impartially. He believes that a judge’s role is not to legislate from the bench but to interpret and enforce the law as it was intended at the time of enactment.
Warren illustrated his philosophy through an example of his work on expungement cases, highlighting his adherence to the law even when personal opinions might differ. Despite potential disagreements with certain laws, Warren stated that his duty is to uphold and apply the existing legal framework without bias.
Nomination and Political Affiliation
Warren’s unique position as a candidate nominated by both the Michigan Republican Party and the Libertarian Party of Michigan stands out in the current political landscape. While he acknowledges the historical significance of this dual endorsement, Warren clarified that he has not been formally nominated by the Libertarian Party due to legal restrictions on fusion voting.
Regarding concerns about having support from two distinct political parties, Warren stressed that his focus as a jurist lies in upholding the Constitution and the law, rather than engaging in political debates or policy discussions. He views the alignment between Republicans and Libertarians as an advantage in his candidacy.
Future Goals and Vision
Warren’s diverse legal background, including clerking for a former Supreme Court Justice and working in private firms, has provided him with a comprehensive understanding of the state’s judicial system. If elected to the Supreme Court, Warren aims to address practical issues within the court system, emphasizing the importance of judicial experience and expertise in decision-making.
From overseeing attorney-grievance disciplinary proceedings to managing ethical considerations and bar admissions, Warren intends to leverage his hands-on knowledge of legal practices to contribute to the effective functioning of the state’s highest court.
The Supreme Court’s administrative processes have come under scrutiny due to the inexperience of some of its justices, according to a recent interview with Judge Warren. He highlighted that the lack of prior judicial experience among current justices has impacted the court’s decision-making. An example he provided was the implementation of a 12-factor test for determining whether a case should be conducted in person or remotely post-COVID. Judge Warren argued that this level of complexity could be unnecessary for judges with extensive trial experience. This raises questions about the efficiency and effectiveness of the court’s operations under these circumstances.
In a recent interview, Judge Warren shed light on the impact of inexperience among Supreme Court justices on the court’s administrative processes. He pointed out a specific instance where the court introduced a 12-factor test to decide on in-person or remote proceedings after the pandemic. This move, according to Judge Warren, unnecessarily burdens judges with an additional administrative task that might be more straightforward for those with extensive trial experience. This revelation has sparked discussions about the implications of having justices without prior judicial backgrounds in key decision-making roles within the Supreme Court.
