Federal Judge Overturns Trump Administration’s H-1B Visa Fee Hike

A recent ruling by a federal judge in Boston has overturned the Trump administration’s policy of imposing a $100,000 fee on new H-1B visas. This decision came after 20 states challenged the fee hike, arguing that it exceeded the executive branch’s authority and violated the Administrative Procedure Act.

U.S. District Court Judge Leo Sorokin sided with the states, stating that the policy imposed a tax on H-1B petitions without proper congressional delegation. The H-1B visa program is designed for high-skilled jobs that are challenging to fill with American workers, with a significant portion going to workers from India, particularly in the technology sector.

Before the fee increase, H-1B visa applications already cost several thousand dollars, causing confusion and concern among employers, students, and workers in the U.S. and abroad. The ruling has implications for various sectors, including education, healthcare, and medical research, where the visa program plays a crucial role in addressing labor shortages.

Massachusetts Attorney General Andrea Joy Campbell hailed the decision as a victory for critical industries like education and healthcare, emphasizing the importance of filling essential vacancies in these fields. Similarly, Bobby Mukkamala, the president of the American Medical Association, praised the ruling for allowing talented physicians and healthcare professionals to continue serving patients.

However, the Department of Homeland Security expressed disagreement with the court’s decision, criticizing it as “blatant judicial activism” that undermines the administration’s efforts for immigration reform. The agency reiterated its commitment to reforming the immigration system to benefit American citizens, workers, and families.

While the administration remains confident that the ruling will be overturned on appeal, the decision marks a significant development in the ongoing legal battles surrounding the H-1B visa program and the associated fee hike.
